Analysis: NY federal judge an outlier in challenging SEC (Reuters)

NEW YORK (Reuters) ? Judge Jed Rakoff's blunt rejection of a major Citigroup Inc (C.N) securities fraud settlement could resonate with other judges who share the public's frustration with Wall Street and its regulators.

Rakoff is considered an outlier on the federal bench, a judge who rails against the U.S. Securities and Exchange Commission's policy of settling almost all lawsuits without defendants admitting wrongdoing.

Courts have typically approved similar pacts between government agencies and corporate defendants with few questions.

But Rakoff's order on Monday blocking the proposed $285 million settlement over the sale of toxic mortgage debt was a populist decision that could influence other judges.

This is the second time in two years that he has rejected a high-profile SEC settlement.

"It's man bites dog. Judge bites agency," said Professor Adam Pritchard, of the University of Michigan Law School. "You haven't heard about this sort of thing before because it doesn't happen."

In striking down the SEC's $33 million settlement with Bank of America (BAC.N) over its failure to disclose that it had authorized bonus payments to Merrill Lynch employees as part of its takeover of Merrill in 2009, Rakoff said it unfairly punished shareholders. He later approved a $150 million pact.

Some judges recently have made strong interventions in settlements, but not those involving allegations of securities fraud.

The 68-year-old Rakoff is known for his acerbic opinions and maverick style. He was appointed to the federal bench in 1995 by Democratic President Bill Clinton.

In Monday's ruling, the Manhattan federal judge said Citigroup was getting off too easy by the settlement.

The pact would have required the bank to pay a $95 million fine, which Rakoff called "pocket change" for Citigroup, and give back alleged ill-gotten profit. He said the court would be a "handmaiden to a settlement privately negotiated on the basis of unknown facts" if he were to approve it.

Rakoff "does seem to be getting angrier" and had written an opinion "not just concerning this case," said Professor Robert Hillman of University of California Davis School of Law. "It's likely that some other federal judges will be influenced."

Still, few judges are expected to mimic Rakoff's signature style. "Maybe they'll act in a more restrained way and maybe there won't be some of Rakoff's rhetorical flourishes," Hillman said.

SEC ON THE SPOT

The white-haired, white-bearded Rakoff practiced law for 26 years, both as a federal prosecutor and in private practice, before he became a judge. He is a 1969 graduate of Harvard Law School and earlier studied English literature at Swarthmore College near Philadelphia, his home city.

In December last year, Rakoff assumed senior status, a form of semi-retirement for federal judges but does not prevent them from taking a full case load.

Rakoff has a history of bold rulings.

In a 2002 murder case, he declared the death penalty unconstitutional. The decision was reversed by the 2nd U.S. Court of Appeals, where Rakoff occasionally sits on panels in the federal courthouse in lower Manhattan.

Rakoff's latest high-profile decision puts the SEC on the spot, said Boston University School of Law Professor Cornelius Hurley.

"If they appeal, they run the risk of having it being affirmed and that would be a problem for the SEC."

He said the ruling "plays into the obvious frustration of the populace that companies are getting off with very inconsequential penalties and no findings of facts or law as to violations."

In its complaint, the SEC accused Citigroup of selling a $1 billion mortgage-linked collateralized debt obligation, Class V Funding III, in 2007 as the housing market was beginning to collapse, and then betting against the transaction.

The SEC said the CDO caused more than $700 million of investor losses. One Citigroup employee, director Brian Stoker, was charged by the SEC, and is contesting those charges.

Citigroup and the SEC argue that their proposed accord is fair. The complaint against the bank "fully and accurately sets forth the facts that support our claims" and the basis for the proposed settlement, SEC Director of Enforcement Robert Khuzami said in a statement.

Federal courts have long had the authority to assess the terms of a settlement in certain cases -- those brought as class actions, for instance. But Rakoff has led a spread of that authority into other areas of judicial enforcement.

"There is an increasing sense in the federal courts that if the court is being asked to exercise its powers in furtherance of a settlement, the court needs to have more authority over more terms of the settlement," said New York University law professor Samuel Issacharoff.

That trend has spread outside of securities cases to other complex cases, he said.

After Rakoff's 2009 rejection of an initial settlement between the SEC and Bank of America, for example, another judge in the same court, Alvin Hellerstein, rejected a pact in 2010 between an insurance fund and people who became sick after working at the World Trade Center site after the September 11 attacks.

Hellerstein refused to approve the proposed $657 million settlement until the parties lowered legal fees and provided the individual plaintiffs with a proposed dollar amount they would receive. He later approved a reworked $712 million deal.

The action was filed not as a class action but as a mass tort, a legal mechanism that does not historically include direct judicial authority in approving a deal.

"The judge's involvement in approving a settlement that was between private parties, we felt was very, very unusual," said Marc Bern, lawyer for the emergency workers.

The case is SEC v Citigroup Global Markets Inc, U.S. District Court, Southern District of New York, No. 11-07387.

(AP) ? A person familiar with the decision says Jaguars owner Wayne Weaver is selling the team to Illinois businessman Shahid Khan.

The person told The Associated Press that Khan, who was born in Pakistan in 1950 and moved to the United States when he was 16, and Weaver's deal is not expected to move the team.

The person spoke on the condition of anonymity because no public announcement has been made regarding the sale of the team.

The Jaguars have scheduled a noon press conference during which they are expected to discuss all the leadership changes, which includes signing general manager Gene Smith to a new three-year deal and Monday's firing of head coach Jack Del Rio.

(AP) ? Green cars rolled into the spotlight at the Tokyo auto show as Japan's automakers look to fuel efficient technology to reinvigorate growth after tough times.

The showcase for Japan's pillar auto industry was holding its preview for media on Wednesday ahead of opening to the public on Saturday.

Plug-in hybrids and electric cars are centerstage at the Tokyo Motor Show ? reflecting both how green cars are growing in popularity and the low profile of foreign automakers at the event.

The show been scaling back in recent years because of the waning importance of Japan as an auto market. Car makers ? including Japan's ? are increasingly looking to China, India and other nations with greater growth potential.

Ford Motor Co. of the U.S. skipped the show, and General Motors Co. had only a tiny corner booth. Just a handful of European makers such as BMW with a chance at wooing rich Japanese buyers had full-scale booths.

Japanese automakers have had a tough few years due to the strong yen, image problems from Toyota's massive recalls and the large production disruptions from the March disasters in northeastern Japan. But green technology remains a strong selling point for car makers such as Toyota Motor Corp. which pioneered broad consumer acceptance of gasoline-electric hybrid cars with its hit Prius.

Honda Motor Co. said it will start selling an electric version of its Fit subcompact in the U.S. and Japan by the middle of next year. It showed concept cars such as the AC-X plug-in hybrid, EV-STER electric roadster convertible and a tiny electric car called Micro Commuter

"We will continue to offer products with an edge," said Honda President Takanobu Ito before drinking orange juice poured by Honda's Asimo robot, which recently has gained more nimble human-like fingers.

Honda showed a portable battery that people could carry around and put not only in their electric cars and plug-ins but also in small electric scooters.

Nissan Motor Co. had an updated version of its futuristic-looking electric car called Pivo 3, which can drive itself, find parking spaces and swerve around in almost a complete circle.

Koichiro Imoto, who writes about Japan's auto industry, says overseas interest in the show has plunged, except for a handful of manufacturers like Volkswagen AG that do good business in Japan.

"Technology is the only thing Japan has to cling to so the show is trying to highlight those strengths," he said. "Selling the technological superiority is the only way left for Japan."

Toyota President Akio Toyoda was outright emotional at his presentation when he said Japan was going through hard times after the March 11 earthquake and tsunami in northeastern Japan.

Japanese automakers, including Toyota Motor Corp., were forced to scale back production as parts suppliers in northeastern Japan were damaged.

That battering was followed by a smaller but similar problem when suppliers got hit by flooding in Thailand, Toyoda said.

"Japan has been plunged into sadness," he said, often gesturing with his hands to emphasize his points.

Toyota must do all it can to work with the people of northeastern Japan and Thailand to propel a recovery, he said.

"Our messages are 'Fun to drive again,' and 'Never give up,' " he said, using English phrases for the mottos.

Mamoru Katou, auto analyst with Tokai Tokyo Research, believes the most interesting models at the show are the ones close to being commercial models.

On display at Toyota's sprawling booth is the plug-in version of its hit Prius hybrid, which will start at 2.75 million yen ($35,200) with subsidies in Japan.

Toyota began taking orders in Japan for the plug-in on Tuesday. In the U.S., where Toyota has already started to take orders online, the car starts at $32,000 without subsidies, which will vary by state.

Toyota, which has sold more than 3.4 million hybrids worldwide so far, is targeting Prius plug-in sales of 60,000 a year globally. The car is set for delivery in Japan in January.

Toyota is also showing an electric car and a fuel cell prototype.

"Overall, interest is going to be diminished because the economy isn't doing so well around the world," Katou said. "But there's still interest in Toyota cars."

Carlos Ghosn, chief executive at Nissan ? which has been aggressive on electric vehicles with its Leaf car, but has been a straggler with hybrids compared to Toyota and Honda ? said no single green technology was going to dominate.

In about a decade, electric vehicles will make up 10 percent of the auto market as concerns grow about global warming, and governments in the U.S., Japan, Europe and China encourage their sales, he said.

"Zero-emission cars are going to become more and more popular," Ghosn said on the sidelines of the show. "You need to prepare the technologies."

Thanksgiving is over, and like it or not we have officially entered the season of holiday parties. Personally, I love this time of year. Not only because of the decorations and festivities and gift-giving, but because from now until New Year's Day, everyone will be breaking out the bubbly.

I admit it: I am a total sucker for Champagne. I love the bubbles, the crisp, dry taste, the elegant flutes. It's fun, it's festive, and it makes any moment better. Of course, opening a bottle of true Champagne can set you back $50 or more. Which is why I've become somewhat of an expert on budget bubblies -- lovely, dry sparklers that are sophisticated and celebratory without breaking the bank.

There are such a wide array of sparkling wines available these days, that it's hard to make sense of what is what. To break down a few of the terms you will encounter, here is my little bubbly cheat sheet:

Brut - This means "dry" and is found on the labels of many sparkling wines.
Cava - Spanish sparkling wine made using the Methode Champenoise. It is usually the driest of the sparkling wines.
Champagne - French sparkling wine made only in the region of Champagne. These tend to be the most expensive and have some of the most widely recognized labels (Mumm, Krug, Veuve Clicquot, Cristal, Dom Perignon), as well as smaller independent grower-producers. Champagne is tightly regulated and can only be made from three grapes (either blended or solo): Chardonnay, Pinot Noir and Pinot Meunier. Its flavors can be quite complex, with yeasty, toasty aromas and a golden color (which gets darker as it ages).
Cremant - French sparkling wine from other regions, such as Cremant d'Alsace, Cremant de Bourgogne and Cremant de Loire. These have much lower price-points than Champagne, but often have wonderfully aromatic flavors from grapes like Chenin Blanc or Vouvray.
Demi-Sec - A sweet, dessert style sparkling wine.
Extra-Dry - Contrary to what you might think, extra-dry is actually sweeter than brut, usually served as an aperatif. It's perfect for someone who wants a bit of sweetness, without going as sweet as a demi-sec.
Methode Champenoise/Traditional Method - A sparkling wine made in the traditional Champagne method, i.e. the second fermentation (which creates the bubbles) takes place in the bottle. This is slightly more expensive than the Prosecco method, and usually creates more complex wines.
N.V. - This stands for non-vintage and is often found on the labels of sparkling wines. This simply means that the wine is not from a certain year, but rather a blend of wines from several years to make sure the quality is consistent from year-to-year.
Prosecco - Italian sparkling wine, made using a method where the wine undergoes a second fermentation in large tanks and is bottled under pressure. Prosecco tends to have finer bubbles than Champagne and can be a bit on the sweeter side.

I've worked at a few wine shops over the years, which has given me ample opportunity to taste a variety of bubblies -- both on the pricey end and the budget side of things. This list is by no means definitive (you'll notice there's not a Prosecco on the list, which I happen to love), but it does give several fabulous, under-$20 options to take to a party, or pop open tonight! Personally, I'd recommend the latter...

Swedish 'Dragon Tattoo' star's daughter in US film (AP)

NEW YORK ? The star of Sweden's "The Girl with the Dragon Tattoo" movie says his daughter appears in the upcoming U.S. remake with the actor who takes on his role in the crime drama: Daniel Craig.

Michael Nyqvist and Craig both play investigative journalist Mikael Blomkvist in films based on the crime trilogy from Swedish author Stieg Larsson.

Sweden's "Millennium" television series, which includes adaptations of Larsson's other books in the series "The Girl Who Played with Fire" and "The Girl Who Kicked the Hornets' Nest," just won the 2011 International Emmy for best TV miniseries.

Swedish-born Nyqvist said he was curious to see the American version because he says David Fincher "is such a good director and Craig is a good actor," and because his 21-year-old daughter, Ellen, is an extra in the film "by coincidence."

The film shot in a Los Angeles café where his daughter, a college student, was working. She landed a walk-on role that included pouring coffee for Craig, who has played James Bond.

According to Nyqvist, while she was pouring she turned to Craig and asked, "Do you know who my dad is?"

The film's distributor, Columbia Pictures, confirms Ellen Nyqvist appears in one scene with Craig.

The elder Nyqvist, who is a huge star in Sweden, plays the villain Hendricks in the upcoming, "Mission Impossible: The Ghost Protocol" starring Tom Cruise. The latest "Mission: Impossible" and "The Girl with the Dragon Tattoo" open Dec. 21.

Nyqvist says he has also just wrapped the film "Disconnect" with fellow Swede Alexander Skarsgard, son of another Swedish acting icon Stellan Skarsgard, an old friend of Nyqvist who, coincidentally, has a supporting role in the upcoming "Dragon Tattoo" film.

Texas asks court to stop redistricting plan (AP)

WASHINGTON ? The Supreme Court has been asked to stop a federal court from implementing a state redistricting map in Texas that could increase minority representation in the state Legislature.

The state's attorney general, Greg Abbott, filed the request with the high court on Monday. The court-drawn map was drafted after minority groups challenged the original plan passed by the Republican-dominated state Legislature.

The map drawn by the San Antonio-based federal court could lead to greater minority representation and give Democrats a chance to add as many as a dozen seats in the Legislature. Abbott and other Republican leaders have denied that any of the legislature's redistricting maps would diminish minority voting power.

The court-ordered map will remain in place until the legal fights are resolved.

If you raise the price, they'll still come (AP)

NEW YORK ? The way Americans are chomping Big Macs, lacing up pricey sneakers and gulping peppermint mochas in this economy, you'd think they're taking advantage of big holiday discounts.

The truth is they're paying more.

McDonald's, Nike, Starbucks and other companies initially worried that customers would run the other way when they started raising prices to offset their higher costs for ingredients, fuel and packaging. But so far, cash-strapped Americans largely have swallowed the price spikes. And they're continuing to do so during this holiday shopping season.

On a recent weekday, five full floors of shoppers in a Nike store in New York didn't seem to mind paying more for their favorite kicks, including the almost $200 sneakers named for NBA star LeBron James. At a McDonald's across town, people munched on Big Macs and fries that cost a dime or two more than last year. Customers also piled into a Starbucks down the street, where cappuccinos and many other specialty drinks now top $5.

Timothy and Katrin Sullivan, a San Diego couple, estimate that together they spend about $100 a month on skinny caramel macchiatos and pumpkin spice lattes at Starbucks, where prices on some drinks have risen in some regions this year. As parents of five children, they worry about the economy and have cut back on travel and ball games, but so far their morning cup of joe has survived the chopping block despite the rising price.

"It's cheaper than therapy," says Katrin Sullivan, 39.

The prices Americans pay for food, travel and other things have steadily risen this year, according to government data. Prices went up 3.5 percent in October compared with the same month a year ago. At the same time, every month for the past year except one, spending grew 2 percent or more compared with the same month a year ago. That's given retailers some cautious optimism as they try to gauge just how much more consumers are willing to pay.

Pete Bensen, McDonald's chief financial officer told analysts during the company's earnings call that the question boils down to this: "Is the consumer in a place that we're comfortable we can continue to add price increases?"

Companies of all stripes have been asking that question a lot. In the past year, they've been paying more for materials like beef, corn and fuel that they use to make, package and transport their goods. A combination of poor crop yields in some parts of the world, unrest in the Middle East and greater demand from countries like Brazil and China have sent those costs up.

Many costs have come down after spiking in the spring. A pound of coffee, for example, is trading at about $2.30, down from $3 in the spring. But that's up from $2 a year ago.

As a result, Starbucks Corp. this year raised the price of the packaged coffee in its stores by 17 percent. The company declines to say whether prices on brewed drinks have risen or fallen overall in the past year, since those price decisions vary by region. But generally, the Seattle chain says the prices of specialty drinks like lattes and macchiatos are more likely to have risen this year than simpler drinks.

The price of a 16-ounce grande cappuccino at Starbucks costs about $4.25, up about 23 percent from $3.45 a year ago, research firm Technomic estimates. Meanwhile, a bagel went up from $1 a year ago to $1.25.

That hasn't stopped Starbucks customers from getting their coffee fix, though. Store traffic rose 6 percent in the most recent fiscal year, which ended in October. Revenue at stores open at least a year ? an indicator of a retailer's health ? rose 8 percent.

"We think we are in a very good spot right now," Jeff Hansberry, who runs Starbucks' consumer products division, said in a call with analysts this month.

At Nike Inc., sales rose almost 18 percent in the three-month period through August, even though it raised prices on certain styles this year. Nike hasn't detailed the price increases, but according to research firm SportsOneSource Group, the suggested price of a pair of this year's version of LeBron James' sneakers is about $170, up from about $160 last year. Nike said it expects to raise prices more broadly in the spring.

"We have not seen any big price resistance at all," Charles Denson, president of the Nike Brand, said in a call with analysts.

Likewise, traffic and sales grew after McDonald's raised prices an average of 1 percent in March and another 1.4 percent in May. In the third quarter, guest count increased 2.6 percent. Revenue at stores open at least a year rose 5 percent. (The revenue figure is a snapshot of money spent on food at both company-owned and franchised restaurants. It does not reflect corporate revenue.)

McDonald's won't give details on which items it raised prices on, but Technomic estimates that a Big Mac costs an average of $3.39, up from $3.19 a year ago. A large order of fries is about $1.89, up from $1.79.

And the company signaled that there may be more increases to come. "We will continue to evaluate additional price increases," said Bensen, McDonald's CFO, during a call last month. "As we look into 2012, we expect commodity cost increases in the U.S. to be similar to this year's."

Even if the costs for some raw materials decline, companies are still expected to continue to raise prices during this holiday shopping season. That's because costs for materials are uncertain, so companies will try to raise prices whenever they think customers will tolerate them. Still, they have to tread lightly or risk losing customers.

To be sure, families have trimmed their budgets as the economy plummets. But Americans continue to spend for myriad reasons, even though prices have risen on everything from Coca-Cola soda to Huggies diapers to Ben & Jerry's ice cream.

Some are stomaching the higher prices only on products they need. Others who've cut back on bigger frills are willing to splurge on brands they trust or things they see as small indulgences. Still others are apathetic to the increases because "everybody's doing it."

The weak economy has forced Kenya Leach, a New York actress, to cut back on eating out and trips to the movies and to reconsider her plans to return to school for an anthropology degree. Still, she keeps buying beauty products from Origins, which sells $35 moisturizer and $25 face wash, even though she's noticed those prices edge up by about a dollar per product, by her calculations.

Estee Lauder, the high-end cosmetics company that owns Origins, did not detail its price increases. But CEO Fabrizio Freda said recently during an analyst call that customers have been "resilient" as the company has raised prices and rolled out more expensive products.

Leach, for one, figures it's OK to spend a little more on Origins products because she is cutting out so many other things. "Treating yourself sends off those happy pheromones," says Leach, 25. "When I get really crabby and upset, I'll buy a new lipstick and I'll feel 10 times better."

Pakistan stops NATO supplies after raid kills up to 28 (Reuters)

YAKKAGHUND, Pakistan (Reuters) ? NATO helicopters and fighter jets attacked two military outposts in northwest Pakistan on Saturday, killing as many as 28 troops and plunging U.S.-Pakistan relations, already deeply frayed, further into crisis.

Pakistan retaliated by shutting down vital NATO supply routes into Afghanistan, used for sending in almost half of the alliance's non-lethal materiel.

The attack is the worst single incident of its kind since Pakistan uneasily allied itself with Washington in the days immediately following the Sept 11, 2001 attacks on U.S. targets.

Relations between the United States and Pakistan, its ally in the war on militancy, have been strained following the killing of al Qaeda leader Osama bin Laden by U.S. special forces in a raid on the Pakistani garrison town of Abbottabad in May, which Pakistan called a flagrant violation of sovereignty.

The Pakistani government and military brimmed with fury.

"This is an attack on Pakistan's sovereignty," said Prime Minister Yusuf Raza Gilani. "We will not let any harm come to Pakistan's sovereignty and solidarity."

The Foreign Office said it would take up the matter "in the strongest terms" with NATO and the United States.

The powerful Chief of Army Staff, General Ashfaq Pervez Kayani, said in a statement issued by the Pakistani military that "all necessary steps be under taken for an effective response to this irresponsible act.

"A strong protest has been launched with NATO/ISAF in which it has been demanded that strong and urgent action be taken against those responsible for this aggression."

The commander of NATO-led forces in Afghanistan, General John R. Allen, said he had offered his condolences to the family of any Pakistani soldiers who "may have been killed or injured" during an "incident" on the border.

A spokesman for the force declined further comment on the nature of the "incident" and said an investigation was proceeding. It was not yet clear, he said, whether there had been deaths or injuries.

The U.S. embassy in Islamabad also offered condolences.

"I regret the loss of life of any Pakistani servicemen, and pledge that the United States will work closely with Pakistan to investigate this incident," ambassador Cameron Munter said in a statement.

EARLY MORNING ATTACK

Two military officials said that up to 28 troops had been killed and 11 wounded in the attack on the outposts, about 2.5 km (1.5 miles) from the Afghan border. The Pakistani military said 24 troops were killed and 13 wounded.

It remains unclear what exactly happened, but the attack took place around 2 a.m. (2100 GMT) in the Baizai area of Mohmand, where Pakistani troops are fighting Taliban militants.

"Pakistani troops effectively responded immediately in self-defense to NATO/ISAF's aggression with all available weapons," the Pakistani military statement said.

About 40 Pakistani army troops were stationed at the outposts, military sources said. Two officers were reported among the dead.

"The latest attack by NATO forces on our post will have serious repercussions as they without any reasons attacked on our post and killed soldiers asleep," said a senior Pakistani military officer, requesting anonymity.

Reflecting the confusion of war in an ill-defined border area, an Afghan border police official, Edrees Momand, said joint Afghan-NATO troops near the outpost on Saturday morning had detained several militants.

"I am not aware of the casualties on the other side of the border but those we have detained aren't Afghan Taliban," he said, implying they were Pakistani Taliban operating in Afghanistan.

The Afghanistan-Pakistan border is often poorly marked, and differs between maps by up to five miles in some places.

The incident occurred a day after Allen met Kayani to discuss border control and enhanced cooperation.

"After the recent meetings between Pakistan and ISAF/NATO forces to build confidence and trust, these kind of attacks should not have taken place," a senior military source told Reuters.

BLOCKED SUPPLIES

NATO supply trucks and fuel tankers bound for Afghanistan were stopped at Jamrud town in the Khyber tribal region near the city of Peshawar hours after the raid, officials said.

"We have halted the supplies and some 40 tankers and trucks have been returned from the check post in Jamrud," Mutahir Zeb, a senior government official, told Reuters.

Another official said the supplies had been stopped for security reasons.

"There is possibility of attacks on NATO supplies passing through the volatile Khyber tribal region, therefore we sent them back toward Peshawar to remain safe," he said.

The border crossing at Chaman in Baluchistan was also closed, Frontier Corps officials said.

Pakistan is a vital land route for 49 percent of NATO's supplies to its troops in Afghanistan, a NATO spokesman said.

A similar incident on Sept 30, 2009, which killed two Pakistani troops, led to the closure of one of NATO's supply routes through Pakistan for 10 days.

NATO apologized for that incident, which it said happened when NATO gunships mistook warning shots by the Pakistani forces for a militant attack.

U.S.-Pakistan relations were already reeling from a tumultuous year that saw the bin Laden raid, the jailing of a CIA contractor, and U.S. accusations that Pakistan backed a militant attack on the U.S. Embassy in Kabul.

The United States has long suspected Pakistan of continuing to secretly support Taliban militant groups to secure influence in Afghanistan after most NATO troops leave in 2014. Saturday's incident will give Pakistan the argument that NATO is now attacking it directly.

"I think we should go to the United Nations Security Council against this," said retired Brigadier Mahmood Shah, former chief of security in the tribal areas. "So far, Pakistan is being blamed for all that is happening in Afghanistan, and Pakistan's point of view has not been shown in the international media."

Other analysts, including Rustam Shah Mohmand, a former ambassador to Afghanistan, said Pakistan would protest and close the supply lines for some time, but that ultimately "things will get back to normal."

Paul Beaver, a British security analyst, said relations were so bad that this incident might have no noticeable impact.

"I'm not sure U.S.-Pakistan relations could sink much lower than they are now," he said.

Scientists uncover new role for gene in maintaining steady weight

Against the backdrop of the growing epidemic of obesity in the United States, scientists from the Florida campus of The Scripps Research Institute have made an important new discovery regarding a specific gene that plays an important role in keeping a steady balance between our food intake and energy expenditure. The study may help scientists better understand the keys to fighting obesity and related disorders such as diabetes.

The study, which was published in the November 25, 2011 print edition of The Journal of Biological Chemistry, focused on the melanocortin-3 receptor (MC3R), which normally responds to signals of nutrient intake.

"What we discovered was quite a surprise," said Scripps Research Associate Professor Andrew Butler, who led the study. "We thought that the actions of the receptor expressed in the brain would be critical for metabolic homeostasis. However, what we found is that actions of the receptor expressed outside the brain appear to be equally important."

The existence of drug targets in areas outside of the central nervous system (the body's "periphery") might help in the effort to develop drugs that influence metabolism without major side effects, Butler said.

The findings were made possible by the team's development of a new transgenic animal model, where expression of the MC3R gene can be selectively "switched on" in different cell types.

In the study, the suppression of MC3R expression in the brain and peripheral tissues had a marked impact on metabolic homeostasis (equilibrium). Interestingly, mice expressing the MC3R gene in the brain only displayed an obese phenotype (physical appearance) similar to those where all types of expression was suppressed, indicating that actions of this receptor in the brain are not sufficient to protect against weight gain. The finding that loss of MC3R activity in the periphery impairs metabolic homeostasis is startling, Butler said, and point to a distinct role for MC3R signaling in the peripheral tissues. However, how the actions of these receptors impacts on obesity remains to be determined.

"It's clear that these peripheral receptors are important and the new mouse model will let us explore that potential," Butler said.

Cluster munition talks reject US proposal (AP)

GENEVA ? A group of 50 nations led by Norway, Austria and Mexico has defeated a U.S. effort to enact a worldwide ban on cluster munitions produced before 1980.

Two weeks of diplomatic talks ended late Friday night with the U.S. government saying it was "deeply disappointed by the failure."

The U.S. mission to the U.N. in Geneva said in a statement Saturday its proposal would have reined in about 85 percent of the world's stockpiles of cluster bombs, artillery shells and missiles.

But opponents including activist groups say that would undermine an international law that took effect last year to phase out cluster weapons, which are packed with "bomblets" that scatter indiscriminately and often harm civilians.

More than 60 nations have adopted the law so far.

NASA's Massive Curiosity Rover Nears Launch toward Mars

The rover formerly known as the Mars Science Laboratory should tackle some of the biggest questions about Mars?assuming it can survive an elaborate touchdown

Don't be fooled by the innocuous name?Curiosity,?NASA's new Mars rover, is a brute.

Curiosity, which is slated to launch Saturday morning on an Atlas 5 rocket from Cape Canaveral Air Force Station in Florida, is the biggest planetary rover ever built. The six-wheel-drive robot is three meters long?longer than a Smart ForTwo mini car?and its headlike mast rises 2.1 meters above the ground. With a suite of 10 science instruments, Curiosity weighs in at nearly 900 kilograms, more than NASA's last three Mars rovers combined. [Read more about Mars exploration in this special report.]

To put its size in perspective, consider that Curiosity is scheduled to touch down in August 2012, just over 15 years after NASA's first Mars rover began exploring the Red Planet. That rover, Sojourner, stood about 30 centimeters high. Curiosity is designed to roll over obstacles twice that tall.

But brute force is not everything?it's what's inside that counts. "We have our generic bigger and better answer" for what is new about the $2.5-billion Curiosity, says John Grotzinger, a planetary geologist at the California Institute of Technology and the NASA Jet Propulsion Laboratory in Pasadena, Calif. Grotzinger, the mission's project scientist, notes that the rover's technology is simply superior to that of its predecessors?the cameras have better resolution, for instance, and can take high-definition video.

And unlike its predecessors, Curiosity will not depend on sunlight to carry out its mission. Instead its power will come from a radioisotope thermoelectric generator?a 4.8-kilogram supply of radioactive plutonium 238 that decays to produce heat. Devices called thermocouples turn some of that heat into electricity, providing about 110 watts to the rover. (The heat also keeps the rover's systems warm enough to function.) Plutonium 238 has a half-life of more than 80 years, so Curiosity may be able to exceed its 23-month nominal mission lifetime by several years.

But the real key to Curiosity's capabilities are two instruments that can make definitive chemical analyses of what the Red Planet is made of. "This is a mobile chemistry laboratory," Grotzinger says. In fact, the Curiosity moniker came along only in 2009, when a Kansas sixth grader named Clara Ma won a naming contest. Prior to that, the mission was known more straightforwardly as the Mars Science Laboratory. The rover's chemical analyses should dig into what Mars was like billions of years ago, when it was wetter and could have featured niches conducive to life.

The two key geology instruments, an x-ray diffraction unit and a multipurpose sample-analysis system, will be fed by a robotic arm that can scoop up soil or drill into a rock to collect a powdered sample from the interior. The x-ray diffraction instrument will aim a beam of x-rays at samples to reveal their structure and composition, making possible definitive identifications of specific minerals. The sample-analysis instruments, on the other hand, can taste the composition of the surrounding atmosphere or heat solid samples to 1,000 degrees Celsius to release trace compounds within.

With its chemistry tools, Curiosity may help shed some light on all-important methane. Some research indicates that methane, a molecule that has mainly biological origins on Earth, is seeping from Mars in plumes that hint at ongoing geologic?or possibly even biological?activity there. If Curiosity encounters methane in the atmosphere, the rover can make isotopic analyses of the gas to help determine the methane's origin.

(AP) ? Pope Benedict XVI insisted on Saturday that all of society's institutions and not just the Catholic church must be held to "exacting" standards in their response to sex abuse of children, and defended the church's efforts to confront the problem.

Benedict acknowledged in remarks to visiting U.S. bishops during an audience at the Vatican that pedophilia was a "scourge" for society, and that decades of scandals over clergy abusing children had left Catholics in the United States bewildered.

"It is my hope that the Church's conscientious efforts to confront this reality will help the broader community to recognize the causes, true extent and devastating consequences of sexual abuse, and to respond effectively to this scourge which affects every level of society," he said.

"By the same token, just as the church is rightly held to exacting standards in this regard, all other institutions, without exception, should be held to the same standards," the pope said.

An official of a U.S. group advocating for victims of clergy abuse lamented that Benedict, with his remarks, was setting a "terrible example" for bishops.

"No public figure talks more about child safety but does little to actually make children safer than Pope Benedict," David Clohessy, national director of the Survivors Network of those Abused by Priests, told The Associated Press in an emailed statement.

"The pope would have us believe that this crisis is about sex abuse. It isn't. It is about covering up sex abuse," Clohessy said. "And while child sex crimes happen in every institution, in no institution are they ignored or concealed as consistently as in the Catholic church."

The pedophile scandal has exploded in recent decades in the United States, but similar clergy sex abuse revelations have tainted the church in many other countries, including Mexico, Ireland, and several other European nations, including Italy.

But the most high-profile sex abuse case in the United States at the moment doesn't involve the church. Penn State university's former defensive football coordinator Jerry Sandusky has been charged with sexually abusing eight boys, and the fallout has led to the firing of longtime coach Joe Paterno and the departure of university president Graham Spanier.

College football in the U.S. is highly popular. The scandal has shaken the reputation of a college program that long had prided itself on integrity.

Benedict didn't address accusations by many victims and their advocates that church leaders, including at the office in the Vatican that Benedict headed before becoming pontiff, systematically tried to cover up the scandals, and that they have rarely been held accountable for that.

Investigations, often by civil authorities, revealed that church hierarchy frequently transferred pedophile priests from one parish to another.

Benedict told the bishops that his papal pilgrimage to the United States in 2008 "was intended to encourage the Catholics of America in the wake of the scandal and disorientation caused by the sexual abuse crisis of recent decades."

Echoing sentiment he has expressed in occasional meetings with victims of the abuse on trips abroad, Benedict added: "I wish to acknowledge personally the suffering inflicted on the victims and the honest efforts made to ensure both the safety of our children and to deal appropriately and transparently with allegations as they arise."

Benedict seemed to be reflecting some churchmen's contentions that the church has wrongly been singled out as villains for the abuse, a view that angered victims' advocates.

"The pope is again setting a terrible example for the world's bishops, echoing the claim by some of them that the church hierarchy is somehow being picked on by the public, the press and their parishioners," Clohessy said .

Despite criticism over U.S. bishops' handling of the abuse scandals, Benedict exhorted the churchmen to be moral compasses for U.S. society. The bishops, in Rome for consultations with the pope that are scheduled every five years, were urged to speak out "humbly yet insistently in defense of moral truth."

Benedict lamented what he called efforts to stop the church from speaking out publicly.

Earlier this month, U.S. Roman Catholic bishops vowed to defend their religious liberty in the face of growing acceptance of gay marriage and what they called attempts by secularists to marginalize faith.

In Illinois, for example, government officials ceased working with Catholic charities on adoptions and foster-care placement because the religious agencies refuse to recognize a new civil union law. Illinois bishops are suing the state.

Bishops have also pressed federal officials for broader religious exception to U.S. President Barack Obama's health care overhaul, which mandates that private insurers to pay for contraception.

"Despite attempts to still the church's voice in the public square, many people of good will continue to look to her for wisdom, insight and sound guidance in this far-reaching crisis," Benedict said, citing what he called a "growing sense of dislocation and insecurity" in the face of economic woes.

But he acknowledged that some of the bishops' own flock are turning away from the church, which he blamed on effects of a "secularized culture." Many U.S. Catholics shun Sunday Mass attendance or disregard such Vatican positions against contraception and divorce.

Huge Macy's parade crowd for beloved - and bizarre - balloons (Reuters)

NEW YORK (Reuters) ? Gigantic balloons floated down New York streets for the 85th Macy's Thanksgiving Day Parade on Thursday, drawing huge crowds to sidewalks and an even bigger audience to television sets, a parade spokesman said.

"We expected 3.5 million people at the parade and I'd say we were north of that," said Orlando Veras, Macy's spokesperson.

Police declined to confirm the numbers, saying they do not release crowd estimates.

Veras said 50 million TV viewers were expected to watch the enormous helium balloons shaped like Snoopy, SpongeBob SquarePants and other beloved characters towed from Central Park to Herald Square in midtown Manhattan.

Offbeat new additions in the parade's 85th year included designer Paul Frank's sock monkey "Julius" and film director Tim Burton's "B.", a creepy but cute boy stitched from discarded birthday balloons.

Temperatures headed toward 60 degrees and virtually windless skies made for perfect parade conditions, a magnet for crowds, Veras said.

"We had a great parade today. I've done this for 11 years and these were the biggest crowds I have seen," he said.

Gaga's Thanksgiving special no turkey for ABC (omg!)

LOS ANGELES (TheWrap.com) - "A Very Gaga Thanksgiving" proved plenty bounteous for ABC.

Though it failed to grab the ratings crown for the night, the holiday special presided over by the "Alejandro" chanteuse provided a significant boost for the network Thursday night, generating a four-year Thanksgiving best in the timeslot and handily beating last year's Turkey Day music offering, "Beyonce's I Am World Tour."

"A Very Gaga Thanksgiving," airing from 9:30 p.m. to 11, averaged a 1.6/3 in the adults 18-49 demographic, a 23 percent improvement over the concert special delivered by her former collaborator Beyonce on the network last season.

The special also averaged 5.4 million total viewers -- an increase of 1.3 million total viewers compared to last year.

Prior to the Gaga special, ABC ran "A Charlie Brown Thanksgiving" at 8, which averaged a 1.7/6 share in the demographic and 5.7 million total viewers -- a 16 percent increase over last year's viewership. A repeat of "The Middle" was sandwiched between the two specials.

CBS, however, won the night's top ratings and best overall performance of the night. A repeat of "The Big Bang Theory" at 8 drew a 3.6/12, easily the night's best performance, and 8.4 million total viewers, which also made it the most-watched program of the night. The rest of the network's primetime slate also consisted of repeats, but despite the lack of fresh programing the network pulled out an overall win, averaging a 2.1/6 and 8.4 million total viewers.

Fox's night began with the special "Ice Age: A Mammoth Christmas" at 8, which drew a 2.3/7 with 7 million total viewers, while another special, "Happiness Is a Warm Blanket, Charlie Brown," from 8:30 to 9:30 averaged a 1.6/5 and 4.9 million total viewers. The network finished the night out with a "Simpsons" rerun.

NBC ran the Dr. Seuss movie "Horton Hears a Who" from 8 to 10, which averaged a 1.1/3 and 3.7 million total viewers, followed by "The 85th Anniversary of the Macy's Thanksgiving Parade," which also averaged a 1.1/3 and 3.7 million total viewers.

Chris Brown Buys Mansion Near Rihanna's Home

R&B star's new Hollywood bachelor pad is just miles away from his ex's house, which she recently put up for sale.

After a successful year on the charts, Chris Brown has decided to make some more noise, this time on the real estate market. Radar Online is reporting that Brown has snatched up a mansion in the Hollywood Hills for a cool $1.5 million. The price tag on the home is not the only eye-opening detail: When Brown moves in, he'll be just miles away from his ex Rihanna.

According to listings site Zillow.com, Brown's new digs went on the market back in 2009 for $2.6 million but dropped by over $1 million by the time the singer snatched it up in October.

Brown's new home is eight miles from Rihanna's front door. But they won't be so close for long. She recently put her eight-bedroom Beverly Crest home on the market for $4.5 million, which, according to real estate site Blockshopper.com, is far above the average $1.35 million asking price for homes in her neighborhood.

Brown had been on the search for a new location since the spring, when, according to Radar, residents in his West Hollywood community complained about his loud lifestyle.

Those complaints might have been a blessing as they opened the door for Brown to score a major deal on the market with the mansion's reduced price tag. The three-bedroom, three-bathroom bachelor pad is listed at 2473 square feet and, according to The Daily Mail, includes an elevator to go along with its outdoor pool, sleek modern patio and living room with two stories of windows.
